1. Agreement to Terms

These Terms of Service (the "Terms") form a legal agreement between you and KRTOMLINSONRENTALS LLC, a limited liability company located at 240 S 210 W, La Verkin, Utah 84745, United States ("KRTOMLINSONRENTALS," "we," "us," or "our"). By accessing or using the website at www.krtomlinsonr.shop (the "Site"), you agree to be bound by these Terms. If you do not agree, do not use the Site.

Equipment rentals are governed by written rental agreements and rate cards issued at booking. If a rental agreement conflicts with these Terms, the rental agreement controls within its scope.

2. The Site and Fleet Information

The Site presents information about KRTOMLINSONRENTALS LLC and the equipment categories we rent — fleet descriptions, leasing process notes and contact channels. It is provided for general informational purposes.

Site content does not guarantee availability. Fleet listings describe equipment categories, not live inventory, specifications or current rates. Availability, unit specifications, terms and pricing are confirmed only in writing through the lease desk.

3. Bookings and Agreements

Submitting a booking request through the Site or by email creates no obligation on either party. A rental forms only when a written agreement is issued and executed, subject to availability, deposit and lessee qualification. We may decline any request at our discretion, including where operator qualification, insurance or use case does not meet requirements for the equipment class.

Rental of aircraft, vessels and regulated machinery requires the lessee to provide qualified operation and documentation as stated in the agreement — the Company supplies equipment only, never crew or operators.

4. Acceptable Use

You agree to use the Site only for lawful purposes. You must not:

• Use the Site in violation of any applicable local, state, national or international law;
• Attempt unauthorized access to the Site, its hosting environment or related systems;
• Probe, scan or test Site vulnerabilities, or breach security or authentication measures;
• Introduce malware or other harmful code, or launch denial-of-service attacks;
• Scrape or harvest Site content or data by automated means without written consent;
• Misrepresent your identity, business, qualifications or intended use in booking requests;
• Use the Site to send unsolicited commercial messages.

We may suspend or block access for conduct that violates these Terms or that we reasonably believe threatens the Site or other users.

5. Intellectual Property

The Site and all of its contents — text, design, layout, graphics, marks, and the selection and arrangement of materials — are owned by KRTOMLINSONRENTALS LLC or its licensors and protected by copyright, trademark and other intellectual property laws. "KRTOMLINSONRENTALS" and the KR mark are identifiers of KRTOMLINSONRENTALS LLC.

You may view, download and print Site pages for personal, non-commercial informational use, provided proprietary notices are kept intact. Any other reproduction, distribution, modification or republication requires our prior written consent.

6. Confidentiality of Communications

Information sent through the Site or by email before a rental agreement exists is handled under our Privacy Policy. Qualification and insurance documents transmitted for booking purposes are retained as required by the agreement and applicable law.

7. Third-Party Links and Services

The Site may link to third-party websites and relies on third-party services (including hosting by Google Firebase). We do not control and are not responsible for the content, availability or practices of third parties. Links are provided for convenience and do not imply endorsement.

8. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES RELATING TO THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free or secure, that defects will be corrected, or that content is complete, current or accurate at any time. Condition and fitness of rental equipment are determined solely by the written agreement and dispatch manifest — nothing on the Site extends or modifies them.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KRTOMLINSONRENTALS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR CLAIMS RELATED TO THE SITE EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Liability under executed rental agreements is governed solely by those agreements. Some jurisdictions do not permit certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify, defend and hold harmless KRTOMLINSONRENTALS LLC and its members, managers, employees and agents from claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Site.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Disputes arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Washington County, Utah, and you consent to their personal jurisdiction.

Before filing a claim, the parties will attempt in good faith to resolve disputes informally. Contact us first at office.xiaoyan@krtomlinsonr.shop and allow at least thirty (30) days for resolution discussions.

12. General Provisions

• Severability. If a provision is found unenforceable, the remainder stays in effect.
• No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
• Assignment. You may not assign these Terms without written consent; we may assign them in connection with a reorganization or sale.
• Entire agreement. These Terms, the Privacy Policy and any signed rental agreement form the entire agreement about the Site.

13. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date reflects the current version. Material changes are posted on this page; continued use of the Site after changes take effect constitutes acceptance.
